Attorney General’s Office Files Notice of Proposed Rulemaking with the Office of Administrative Law and Schedules Public Hearing Regarding Electronic Recordation for California’s 58 Counties

A package of regulations was submitted by the Attorney General’s Office to the Office of Administrative Law on August 24, 2006 and was published to the Notice Register on September 8, 2006. The proposed regulations would authorize a county recorder, upon approval by resolution of the board of supervisors, to establish an electronic recording delivery system for the delivery for recording specified digitized and digital electronic records. The Attorney General is responsible for the system certification, regulations and oversight. The Department of Justice will hold a public hearing from 9:00 a.m. to 12:00 p.m. on October 24, 2006 at the Water Resources Building located at 1416 Ninth Street, Sacramento, CA 95814 in the auditorium located on the ground level. At the hearing, any person may present statements or arguments orally or in writing relevant to the proposed action described in the Informative Digest. The DOJ requests but does not require that persons who make oral comments at the hearing also submit a written copy of their testimony at the hearing.
Any interested person, or his or her authorized representative, may submit written comments relevant to the proposed regulatory action to the DOJ. The written comment period closes at 5:00 p.m. on October 24, 2006. The DOJ will consider only comments received at the DOJ office by that time. In addition, please forward all comments to CLTA’s Executive Vice President and Counsel, Craig Page at cp@clta.org so that we are able to see formal comments from the title industry.
