Title companies would have to strike any provision in the deed or other documents that impose unlawful and unenforceable covenants if Assembly Bill 985 passes. The bill would require a title insurance company that provides a copy of a deed or other written document relating to title to real property, to strike from the deed or other written documents certain unlawful provisions based on characteristics such as race, color, religion, sex,
marital status, national origin, ancestry, familial status, disability, source of income, or sexual orientation. The provisions would have to be stricken before the property is transferred.
