Assembly Bill 1321 (Wiechowski) requires that mortgages, deeds of trust and assignments be recorded within 30 days of the execution or assignment. Further, either the promissory note or a certificate affirming the existence of the promissory note would also have to be attached at the time of recordation. A notice of default could not be recorded until 45 days after the mortgage or deed of trust and any assignment of the mortgage and deed of trust was recorded.
