Mortgage Fraud to Become a Specific Crime
Mortgage fraud cases could be prosecuted under one specifically dedicated felony mortgage fraud statute if SB 239 (Pavley) passes the Assembly where it is now pending. The penalties under the bill would be the same as in the current general felony theft law. Also prosecutors would be allowed to obtain necessary documents from real estate record holders in mortgage fraud cases by a judicial order issued upon a written ex parte application.
